Zionsville Parks and Recreation Rules
All applicable state, federal and local laws, including but not limited to laws governing vandalism, nuisance, litter, animal control and drugs will be enforced. The following rules are provided to supplement the laws and ensure a safe and enjoyable experience when visiting the Town of Zionsville and Parks and Recreation System.
Definitions
For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
- BOARD. The Zionsville Board of Parks and Recreation.
- PARK PROPERTY. All lands and property owned by, or under the control and jurisdiction of the Town Board of Park and Recreation.
- PERSON. Every natural person, firm, partnership, association or corporation.
- SUPERINTENDENT. The Superintendent of Parks and Recreation duly appointed by the Board.
- MOTORIZED VEHICLE. A vehicle that is self-propelled. The term does not include an electric bicycle or an electric personal assistive mobility device.
- CAMPING. The use of a temporary tent, temporary structure, or motorized vehicle as a residence or dwelling for the purpose of living therin, as evidenced by, but not limited to: sleeping, eating food, storage of personal belongings, and/or changing clothes in the tent, structure, or motorized vehicle and/or by the length of time an individual occupies the vehicle when stationary. Any determination of camping must be made by assessing the totality of the circumstances.
Rules and restrictions
- No person shall hunt, trap, snare or kill any bird or animal on park property.
- No person shall fire or discharge a firearm, including air or spring powered pellet or BB guns, or do any other act prohibited by Town Ord. 80-8, on or into any park property.
- No person shall shoot an arrow with a bow or otherwise on or into any park property, unless prior written consent is granted by the Board or Superintendent.
- No person shall operate any motorized vehicle or off-road vehicle, except Town maintenance vehicles, on any park property, except on the designated parking areas.
- The riding of bicycles for recreation within park property is permitted only on trails or other areas designated by the Board for bicycle use. No person shall organize, sanction, hold or engage in any bicycle race or speed contest on park property unless prior written consent is granted by the Board or Superintendent.
- No person shall maintain, construct, assemble or store any building, tree house, stage, structure or personalty on park property. The assembly of temporary tents not exceeding ten feet by ten feet (10' x 10') in size is permitted in conjunction with an approved Town Special Event Permit or a Mulberry Fields sports field reservation, provided that such tents are installed and secured in accordance with all safety requirements and recommendations established by the Fire Marshal.
- No person shall possess or consume any alcoholic beverages or controlled substances, as defined by state criminal statutes, on park property, except for the lawful possession and consumption of alcoholic beverages sold and dispensed by the Zionsville Golf Course, or sold and dispensed by an approved vendor under the Town Special Event application process or as established by a Designated Outdoor Refreshment Area (DORA) Ordinance.
- It is strictly prohibited for any person within any park to sell, advertise or promote publicly any services, good or materials, including commercial products, except in accordance with a Town Special Event Permit and in compliance with all applicable local and state laws and Board policies. All vendors authorized to operate on park property under a Town Special Event Permit shall procure and maintain in full force and effect during the event, with an insurer licensed to do business in the State of Indiana, a commercial general liability policy with coverage of not less than one million dollars per occurrence, and shall name the Board and the Town of Zionsville as additional insured parties. Vendor shall furnish a certificate of insurance to the Town and Board not less than seven (7) days before the special event. All commercial vendors authorized under a Town Special Event Permit shall remit ten percent (10%) of their gross sales generated during the event to the Zionsville Parks and Recreation Department.
- No person shall cut, remove, deface or destroy any tree, shrub, flower or plant excluding the normal and customary maintenance and control of weeds; further that, this provision shall not prohibit removal of any plants and the like made as a part of and necessary to any nature or biology studies conducted by classes under the supervision of their teachers or the Superintendent, and then only with prior written consent granted by the Board or Superintendent.
- Except for barbecue grills installed thereon, no person shall start or cause to be started a fire unless prior written consent is granted by the Board or Superintendent.
- No person shall be on any park property after or before the hours to be specified by the Board and posted at any applicable park property unless prior written consent is granted by the Board or Superintendent.
- No person shall cut, remove, deface, vandalize or destroy any sign, building, structure or other property on park property.
- No personal shall operate motorized equipment or machinery such as a motorized vehicle, motorized toy or an audio device, such as a radio, television set, tape or disc player or musical instrument, louder than necessary for the convenient hearing of such person, thereby disturbing the peace, quiet and comfort of others, unless prior written consent is granted by the Board or Superintendent.
- No person, except authorized Town staff, individuals and entities authorized by the Town, or public safety personnel with jurisdictional authority, shall launch or land, or cause to be launched or landed, any Unmanned Aerial Vehicles (UAV) within park property except in designated areas.
- No person shall park any motor vehicle or trailer on any park property including parking areas after or before the hours to be specified by the Board and posted at any applicable park property unless prior written consent is granted by the Board or Superintendent.
- No person shall swim anywhere except within designated swimming areas.
- No horses or horse trailers are allowed except on designated equestrian trails and in designated equestrian facilities.
- No camping permitted on park property as defined in subsection (A) unless prior written consent is granted by the Board or Superintendent.
Prohibited Behaviors
No person shall engage in any of the following behaviors, all of which are strictly prohibited and, if exhibited, may result in criminal charges, fines pursuant to the Town of Zionsville Code of Ordinances and/or suspension from access to Zionsville Parks and Recreation Department programming and/or park and facilities.
- Creating any unreasonable and substantial risk of harm to the health and safety of other members, participants, patrons, staff, or living creatures.
- Engaging in any harassment, threats to intimidate, or disorderly conduct directed at patrons, participants, volunteers, or staff, or in violation of any federal, state, or local laws, including, but not limited to, obscene, threatening, or insulting language or gestures.
- Entering or remaining on any park property other than during posted park hours of operation or in an area not open to the public, unless specifically authorized by the Superintendent.
- Disrupting any Parks and Recreation Department program, event, sponsored or approved activity or creating a disturbance at a facility.
- Refusal to follow program and//or facility rules and guidelines.
- Theft, damage or vandalism of private or Town facilities, equipment or supplies.
- Possession of weapons such as, but not limited to knifes, clubs, brass knuckles or threats of these weapons.
- Refusal to follow program and/or facility rules and guidelines.
- Engaging in any lewd or lascivious conduct, inappropriate display of affection, including but not limited to prolonged kissing, indecent exposure, or sexual misconduct.
- Defacing, removing, mutilating, or altering park property, including, but not limited to, buildings, fixtures, grounds, signs, plants, trees, soils, habitats, and other structures.
